Tope Alabi, the Nigerian gospel singer, has threatened legal action over false and defamatory claims linking her to gospel singer Toluwanisings’ death.
Her solicitors, Oakmount Legal Practitioners, issued a public notice on Friday. They said Alabi had instructed them to pursue legal remedies against those spreading the claims.
The warning followed an allegation by a Facebook user identified as Tayo. The user claimed that Alabi, Woli Agba, Dele Omo Woli and Woli Arole had a hand in Toluwanisings’ death.
Lawyers warn against defamatory posts
In the notice, the lawyers said Alabi had spent nearly 30 years building her reputation.
“Take further notice that our Client has, for almost thirty (30) years, built a reputation of integrity, honour and public trust in her personal, professional and spiritual life. That reputation is a valuable personal and professional asset, and it is protected by law.”
The firm warned that people who publish false or malicious statements about the singer could face legal action.
It added that liability could extend to those who repeat, repost, share or forward the claims. Those who amplify the material could also face consequences, depending on the circumstances and available legal defences.
The lawyers also warned that anonymous accounts would not automatically protect users from legal liability.
They said Alabi could ask a court to identify those behind the publications. Such requests could involve social media platforms, hosts or service providers, where legally permitted.
Alabi demands removal of posts
The notice directed people who had already published the material to remove it immediately. It also warned them against sharing it again.
However, the lawyers stressed that deleting a post would not automatically erase liability for its earlier publication.
The firm said Alabi had instructed it to sue anyone whose conduct gave rise to an actionable claim, without further notice.
The proposed remedies include damages and court orders to stop further publication. Alabi could also seek retractions, public apologies and legal costs.
The lawyers, however, clarified that the notice did not seek to restrict truthful statements or fair comment on matters of public interest.
It also recognised the lawful exercise of freedom of expression.
“All our Client’s rights and remedies are expressly reserved. Be advised accordingly.”
