The Supreme Court of Nigeria has dismissed an appeal filed by Nyesom Wike, challenging the jurisdiction of the Election petitions tribunal which nullified his election last week.
The tribunal, led by Justice Mohammed Ambrosa upheld the claim by the All Progressives Congress candidate, Dakuku Peterside, that the April 11 election was not in compliance with the electoral Act.
Wike and PDP challenged the jurisdiction of the tribunal based on the decision of the tribunal to relocate from Port Harcourt to Abuja and alleged that it contravened Section 285 (2) of the Nigerian constitution. The tribunal based its decision to relocate on security concerns in Rivers state.
The Supreme Court dismissed his petition and ruled that the tribunal had jurisdiction to hear the petition by Dakuku Peterside. It ruled that the Tribunal did not contravene any law by relocating the case from Rivers state to Abuja.
