A Federal Court of Appeal sitting in Yola, Adamawa, has nullified the impeachment of the former Governor of Adamawa state, Murtala Nyako by the Adamawa state house of Assembly.
Murtala Nyako was impeached by the Adamawa state House of Assembly on July 16, 2014 on the grounds of gross misconduct by 17 out 25 members of the House.
The unanimous judgment by the five justices of the Court of Appeal led by Tunde Ayotoye stated that his impeachment was not in line with the constitutional requirement and Nyako was not given an opportunity to defend himself fairly.
The court in its ruling stated that the House of Assembly had proceeded with the impeachment despite a standing court order to the contrary.
However, Nyako’s appeal to be returned as governor was struck out and was instead granted by the court all entitlements accruing to him during the period of his impeachment till the end of his tenure.
