‘You Cannot Fight Corruption Without Following Due Process” – Femi Falana
Femi Falana, a Senior Advocate of Nigeria and Human Rights Activist, has said that it is wrong to fight corruption without following due process.
The Senior Advocate of Nigeria also said the Federal Government erred by not following due process in its suspension of the Chief Justice of the Federation, and must learn to respect due process.
Falana who was a guest on Channels Television’s Politics Today also said that the “The power to suspend a sitting Judge in Nigeria, including the Chief Justice, has to be on the recommendation of the NJC.” and that it was wrong for the President to have suspended Justice Onnoghen based on an ex parte order of the code of conduct tribunal.
“You can’t fight corruption without following due process,” Falana said.
He stressed that “The power to suspend a sitting Judge in Nigeria, including the Chief Justice, has to be on the recommendation of the NJC.
“A government can never be in a hurry or allowed to engage in jungle justice for self-help”.
He also argued that the Court of Appeal cannot make an order restraining the CCT from performing its duty.
The human right activist also advised the Federal Government to lift the suspension of the Chief Justice and asked the Onnoghen to resign as he has already admitted that he failed to declare his asset as required by law.
