A Federal High Court sitting in Lagos has implored the Federal Government as well as electricity distribution companies to desist from flouting court orders on electricity tariff.
The suit against the Nigerian Electricity Regulatory Commission (NERC) was instituted by lawyer and rights activist, Toluwani Adebiyi.
Mr. Toluwani had filed an application last yearr in an attempt to restrain NERC from hiking the electricity tariff, citing Nigeria’s epileptic power supply and persistent outages. He argued that the tariffs should not be increased until the NERC increases power generation.
Justice Muhammad Idris had directed all parties to maintain status quo pending the final determination of the suit. Despite this, the NERC implemented the new electricity tariff regime on February 1, directly contravening the court order.
The NERC has also filed for a stay of proceeding which will be determined on Friday.
